1. What tab. is — and what it is not

2. Your responsibilities when filing a Tab

When you file or confirm a Tab, you represent and warrant that:

  1. The claim is truthful, accurate, and made in good faith, and you have a

genuine, good-faith basis to believe the money is owed to you.

  1. You have evidence reasonably supporting the claim and the right to share it.
  2. You are filing for a legitimate personal purpose — not to harass,

threaten, coerce, extort, defame, stalk, or retaliate against anyone.

  1. You are not a debt collector collecting on behalf of a third party, and

you are not using tab. to perform third-party debt collection.

  1. You have the legal right to provide any personal information you enter about

another person, and your doing so does not violate their rights or any law.

You are solely responsible for the content of your Tabs and for any consequences of filing them, including any claims of defamation, invasion of privacy, or harassment. tab. is not responsible for user-generated content.

We are not responsible for the conduct of any user or for any payment made or not made through third-party apps.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, tab. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100.

10. Indemnification

You agree to indemnify and hold harmless tab. from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) content you submit (including any claim that it is defamatory or violates privacy); (b) your violation of these Terms or any law; or (c) your violation of any third party's rights.

11. Dispute resolution; arbitration; class-action waiver

Please read this section carefully — it affects your legal rights, including your right to bring a lawsuit in court.

Informal resolution first. Most disputes can be resolved without formal proceedings. Before starting an arbitration, you agree to first email us at hello@thetab.io with a short description of the dispute and your contact information, and to give us 30 days to resolve it informally.

If we can't resolve it, any dispute, claim, or controversy between you and tab. arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in a small-claims court of competent jurisdiction. You and tab. each waive the right to a jury trial and the right to participate in a class, collective, or representative action. The arbitrator may not consolidate more than one person's claims.

Arbitration administration. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, and may be conducted by telephone, video, or written submissions where permitted. The arbitrator's award is final and binding and may be entered as a judgment in any court of competent jurisdiction.

30-day right to opt out. You may opt out of this arbitration and class-waiver agreement within 30 days of first accepting these Terms by emailing hello@thetab.io from your account email with the statement "I opt out of arbitration." Opting out has no effect on any other part of these Terms.

Governing law. These Terms and any dispute are governed by the laws of the State of Texas, excluding its conflict-of-laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions. If any portion of this Section 11 is found unenforceable, the remainder will remain in effect, except that if the class-waiver is found unenforceable, this entire Section 11 will be void.

12. Changes; termination

We may modify these Terms or the Service at any time; material changes will be posted with a new "Last updated" date. We may suspend or terminate your access at any time. You may stop using the Service and delete your account at any time.

13. Contact

For anything — general questions, abuse reports, takedowns, and legal or removal requests — email hello@thetab.io.
